1. Introduction

Welcome to RideHub. These Terms and Conditions ("Terms") govern your use of our website, located at ridehub.com (the "Site"), and all services provided by RideHub, including our car and motorcycle rental services (collectively, the "Services").

By accessing or using our Site or Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our Services.

2. Definitions

Throughout these Terms, the following definitions apply:

• "RideHub," "we," "us," and "our" refer to RideHub, its owners, directors, officers, employees, agents, and affiliates.
• "You" and "your" refer to the person accessing or using the Site or Services.
• "Vehicle" refers to any car, motorcycle, or other motorized vehicle made available for rent through our Services.
• "Rental Agreement" refers to the specific agreement governing your rental of a Vehicle, which includes these Terms and any additional terms provided at the time of rental.

3. Eligibility Requirements

To use our Services and rent a Vehicle, you must:

• Be at least 21 years of age (25 years for certain luxury or high-performance vehicles).
• Possess a valid driver's license that has been valid for at least one year.
• Meet our driving record requirements.
• Have a valid credit card in your name for payment and security deposit purposes.
• Provide proof of adequate insurance coverage, if required.

Additional eligibility requirements may apply for specific vehicle types. We reserve the right to refuse service to anyone for any reason at our sole discretion.

4. Booking and Reservation

When making a reservation through our Site or Services:

• You agree to provide accurate, current, and complete information.
• Reservations are subject to Vehicle availability and confirmation by RideHub.
• A valid credit card is required to secure a reservation.
• You will receive a confirmation of your reservation via email once it has been processed.

5. Rental Terms

5.1 Vehicle Pick-up and Return

You agree to:

• Pick up and return the Vehicle at the agreed-upon location, date, and time.
• Inspect the Vehicle at pick-up and acknowledge its condition.
• Return the Vehicle in the same condition as received, normal wear and tear excepted.
• Return the Vehicle with the same amount of fuel as at pick-up unless otherwise specified.
• Pay additional charges for late returns at the rate specified in your Rental Agreement.

5.2 Vehicle Use

You agree NOT to:

• Use the Vehicle for any illegal purpose or to transport illegal substances.
• Drive the Vehicle under the influence of alcohol, drugs, or any substance that may impair your ability to drive.
• Transport the Vehicle outside the permitted geographical area without prior written authorization.
• Allow anyone not authorized and listed in the Rental Agreement to drive the Vehicle.
• Use the Vehicle for commercial purposes, such as rideshare services, without prior authorization.
• Use the Vehicle for racing, speed testing, or driving instruction.
• Exceed passenger or weight capacity of the Vehicle.
• Smoke in the Vehicle.
• Transport pets without prior authorization and additional fees.

5.3 Payments and Charges

You agree to pay:

• The rental rate specified in your Rental Agreement, which may include a base rate, mileage fees, and applicable taxes.
• Security deposit, which will be refunded after the Vehicle is returned in satisfactory condition.
• Additional charges for optional services or equipment requested.
• Tolls, parking tickets, traffic citations, and other violations incurred during the rental period.
• Cleaning fees if the Vehicle is returned excessively dirty.
• Repair costs for damage caused during your rental period that is not covered by insurance.
• Service fees for roadside assistance that is not due to mechanical failure of the Vehicle.

6. Insurance and Liability

6.1 Insurance Coverage

We offer various insurance options for your rental. Basic liability insurance is included in your rental rate. Additional coverage options are available for purchase. Insurance coverage is subject to the terms, conditions, and exclusions of the applicable insurance policies.

6.2 Your Liability

You are responsible for:

• Any damage to the Vehicle during your rental period not covered by insurance.
• The full value of the Vehicle in case of theft, if it's determined that you did not take reasonable precautions to secure the Vehicle.
• Any fines, penalties, and legal costs associated with your use of the Vehicle.

6.3 Limitation of Liability

To the maximum extent permitted by law, RideHub shall not be liable for:

• Indirect, incidental, special, exemplary, or consequential damages.
• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages resulting from your inability to use a Vehicle or our Services.
• Any damages or injuries caused by your use of the Vehicle or Services.

Our total liability for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid to us for your rental.

7. Cancellations and Modifications

7.1 Cancellation Policy

Our cancellation policy is as follows:

• Cancellations made more than 48 hours before the scheduled pick-up time receive a full refund.
• Cancellations made between 24-48 hours before the scheduled pick-up time receive a 50% refund.
• Cancellations made less than 24 hours before the scheduled pick-up time do not receive a refund.
• No-shows are charged the full rental amount.

7.2 Modifications

You may request modifications to your reservation, subject to availability and the following conditions:

• Modification requests must be submitted at least 24 hours before the scheduled pick-up time.
• Changes to rental dates, times, or locations may result in rate changes.
• Vehicle upgrades are subject to availability and additional charges.
• Vehicle downgrades may not result in a lower rate if made within 48 hours of the scheduled pick-up time.

8. Intellectual Property

The Site, its contents, and all related intellectual property, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, are the property of RideHub or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

9. User Content

If you submit reviews, comments, or other content to our Site, you grant RideHub a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the content you submit, that the content is accurate, and that use of the content does not violate these Terms and will not cause injury to any person or entity.

10. Prohibited Activities

You agree not to:

• Use the Site or Services for any unlawful purpose or in violation of these Terms.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site or Services.
• Attempt to impersonate RideHub, a RideHub employee, another user, or any other person or entity.
• Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose.
• Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site or Services.

11. Termination

We may terminate or suspend your access to all or part of our Site and Services, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site or Services following the posting of revised Terms means that you accept and agree to the changes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state of Washington, without giving effect to any principles of conflicts of law.

Any dispute arising from or relating to these Terms or your use of our Site or Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Kuhicstad, Washington. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

15. Entire Agreement

These Terms, together with any Rental Agreement and other documents they expressly incorporate by reference, constitute the entire agreement between you and RideHub regarding your use of our Site and Services.
